Samuel Manok-Sanoian successfully strikes out a £1.7 million case involving the administration and distribution of an estate.

This case was highly unusual as the Claimant was given permission (erroneously) by the County Court to increase the value of his claim against our client to just over £1.7 million in circumstances where the client had already satisfied a previous Judgment entered against him.

Samuel applied to set aside the order granting permission and successfully argued that the Court lacked jurisdiction to deal with the claim on the grounds of Res Judicata (i.e. the claim had already been extinguished as a result of Judgment having been entered against the client) and because the value of the claim meant that it should have been commenced in the High Court instead of the County Court. Samuel was also able to obtain a costs order in the client’s favour.
