If you wish to challenge a decision made by a public body (i.e police, social services etc), and all other lines of appeals have been exhausted, it may be possible to commence judicial review proceedings against the public body concerned.

What Is Judicial Review?

Judicial review is a type of court proceeding in which a judge reviews the lawfulness of a decision or action made by a public body.

In other words, judicial reviews are a challenge to the way in which a decision has been reached regarding the legitimacy of the process rather than an assessment of the rights and wrongs of any conclusion reached.

As long as the right procedures have been followed, the court will not substitute what it thinks is the ‘correct’ decision.

But where the assessment process has not been correctly adhered to, any conclusions reached can be challenged, and the authorities concerned can be forced to re-address.
